The Center for Audit Quality (“CAQ”) is a public policy organization that seeks to aid investors and the capital markets by advancing constructive suggestions for change rooted in the audit and accounting profession’s core values of integrity, objectivity, honesty, and trust. The CAQ is dedicated to helping increase public confidence in the auditing process and to maintaining high standards in the accounting profession. On April 28, 2009, this Court granted the CAQ leave to file an amicus curiae brief in support of rehearing this case en banc. On July 22, 2009, the Court granted rehearing en banc and invited the CAQ and other amici to file supplemental briefs. Pursuant to that order, the CAQ respectfully submits this brief in support of defendants-appellees.
